1) These terms & conditions represent a legally binding contract between Holly's House Nanny Agency (the agency) and the employer (the client). These terms and conditions will be deemed accepted by the client upon an applicant (candidate) being introduced for an interview and/or engaged in employment introduced through the agency.
2) The agency acts as a booking agent only and does not employ candidates; candidates are always employed by the client.
3) The details of both the client and the candidate held by the agency are strictly confidential. The client must also treat the information disclosed to them with the same confidentiality and hence these details are not to be passed to any other person or entity.
4) If the client passes on a candidate’s information and this results in the employment of the candidate by another person or entity then the client is responsible for the full placement fee.
5) Where a candidate remains in employment by the client, however unsatisfactorily, the client is responsible for the full booking / membership fee in relation to the employment.
6) There is no fee for cancellation of a booking providing that 24 hours notice has been given. If less than 24 hours notice is given then you will be subject to a minimum charge of 2 hours of the babysitter’s hourly rate.
7) The client agrees to pay the babysitter in full at the end of the evening.
8) The client must pay the babysitter for a minimum of 3 hours even if the time required is less than this.
9) If a membership fee has been paid and consequently the service is not utilised for any amount of time no refund will be made.
10) The agency cannot guarantee that they can find a babysitter for every date requested. If this is occurs no refund will be made.
11) Membership and booking fees are payable within 10 days of the first date the babysitting service is used.
12) The agency acts as an introduction service only and endeavours to find the most suitable candidate, however the final decision of employment is the sole responsibility of the client. The agency accepts no responsibility or liability for the acts or omissions of a candidate or any loss, damage and expense caused to the client by breach of the employment contract between the candidate and the client.
