Terms & Conditions

1) These terms & conditions represent a legally binding contract between Holly’s House Nanny & Childcare Agency (the agency) and the employer (the client). These terms and conditions will be deemed accepted by the client upon an applicant (candidate) being introduced for an interview and/or engaged in employment introduced through the agency.

2) The client agrees to notify the agency within 10 days of agreeing to employ a candidate. Placement fees for the introduction of the candidate are payable within 10 days of the candidates acceptance of employment. If the client pays the invoice within the 10 days a discount may apply.

3) The agency acts as an introduction agent and does not employ candidates; candidates are always employed by the client. The client before commencement of employment should present a written contract to the candidate. This should include all working conditions including salary, notice, grievances, holiday, duties etc.

4) If an offer of employment has been offered to the candidate and accepted and the client then withdraws that offer, the client will be liable for 50% of the placement fee.

5) The details of both the client and the candidate held by the agency are strictly confidential. The client must also treat the information disclosed to them with the same confidentiality and hence these details are not to be passed to any other person or entity.

6) If the client passes on a candidate’s information and this results in the employment of the candidate by another person or entity then the client is responsible for the full placement fee.

7) Should a candidate be employed on a short-term basis and then subsequently employment is extended then the client is responsible for the additional placement fees. It is the client’s responsibility to inform the agency of this change in circumstances.

8) Should the employment of a candidate terminate within 4 weeks of the commencement of employment and the agency is unable to provide a suitable alternative candidate then a 50% refund will be given within 2 weeks and a 25% refund given within 4 weeks. This refund will be granted upon receipt of a valid reason for termination in writing to the agency.

9) Where a candidate remains in employment by the client, however unsatisfactorily, the client is responsible for the full placement fee in relation to the employment.

10) A permanent nanny is not permitted to be classed as self employed by the Inland Revenue. It is the client’s responsibility to ensure that the candidates Tax and National Insurance contributions are deducted from the candidate’s salary and a detailed payslip is provided.

11) The agency acts as an introduction service only and endeavours to find the most suitable candidate, however the final decision of employment is the sole responsibility of the client. The agency accepts no responsibility or liability for the acts or omissions of a candidate or any loss, damage and expense caused to the client by breach of the employment contract between the candidate and the client.
